In the event of termination, any remaining funds in your account will generally be returned to you via an appropriate payment method, except where the funds are subject to investigation, originate from fraudulent activity, or are otherwise withheld pursuant to legal or regulatory requirements. Winnings derived from prohibited or fraudulent conduct may be voided and confiscated.

Winum may also close accounts that have been inactive for an extended period, as defined in our internal policies and applicable regulations. Inactive accounts may be subject to administrative fees, where permitted by law, and these fees will be clearly disclosed in advance. Before closing an inactive account and deducting any fees, we will take reasonable steps to contact you using the contact details on file. If we are unable to reach you and the account balance is unclaimed for a legally specified period, the funds may be treated as unclaimed property in accordance with applicable law, which may require us to remit the balance to a governmental or regulatory body. Account suspension or termination does not relieve you of your obligation to comply with these Terms, including any outstanding financial or legal responsibilities.

Limitation of Liability

To the fullest extent permitted by applicable law, Winum, its affiliates, directors, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of the services, whether based on contract, tort, negligence, strict liability, or any other legal theory. This includes, without limitation, damages for loss of profits, loss of data, loss of goodwill, business interruption, or any other intangible losses, even if Winum has been advised of the possibility of such damages. You acknowledge that gambling involves an inherent risk of financial loss and that you are solely responsible for your decisions and actions on the platform. Winum does not guarantee that you will win any games or receive any particular outcome, and all games are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

In any event, Winum’s total aggregate liability to you for all claims arising out of or related to your use of the services shall not exceed the total amount of deposits you have made into your account with Winum during the three (3) months preceding the event giving rise to the claim. These Terms, as well as any disputes or claims arising out of or in connection with them or with your use of the services, shall be governed by and construed in accordance with the laws of the jurisdiction specified by Winum on its legal information page or as communicated to you during registration, without regard to its conflict of laws principles. You agree that the courts of that jurisdiction shall have exclusive or, where applicable, non-exclusive jurisdiction to hear and determine any legal actions, suits, or proceedings arising out of or relating to these Terms or your use of the services.
